Social care reform in Wales, goodbye to all that, enter the brave new world
On April 6th 2016 Wales will implement its own comprehensive legislation in social care.
These regulations provide for the repeal on April 6th of rafts of UK secondary legislation as it applies to Wales.
This is done in preparation for the implementation of the Social Services & Well-Being (Wales) Act 2014 (the Wales Act) which will commence in major respects on 6th April 2016.
The Welsh Assembly did not gain full competence to pass a social services Act until after the 2011 referendum which led to the implementation of Part 4 of the Government of Wales Act 2006 on 5th May 2011. The Wales Act represents the Assembly's response to the Law Commission report on the reform of care law "Adult Social Care" (Law Commission 326) published on 10th May 2011.
The English response to the Law commission report, the Care Act 2014 was implemented on 1st April 2015.
Whilst there are many similarities between the two Acts, a major difference between the Welsh and English Acts is that the Wales Act incorporates the reform of social services delivery to children.
