Employers will be aware that they must take into account the Acas Code of Practice when dealing with grievances from employees, but handling this process is not always as straight-forward as that. This session will look at the complications which can arise in grievance procedures and will provide a case law update.

The session will include:

  • A reminder of whistleblowing protections and when they might apply to someone who has raised a grievance;
  • Potential discrimination issues when handling grievances, including the risk of victimisation claims after an employee has raised a complaint related to a protected characteristic;
  • Tips on handling the cross-over between disciplinary and grievance procedures; and
  • The risks of a constructive dismissal claim.
