This webinar provided a timely reminder of the law on unfair dismissal during the Covid-19 pandemic when employers may have considered terminating employment contracts. It covered the key questions an employment tribunal will ask in an unfair dismissal claim and also provided an update on recent unfair dismissal case law including:

•    Supreme Court: was a dismissal motivated by whistleblowing in a case where the dismissing officer had no knowledge of the disclosures but was being manipulated by the employee's line manager (Royal Mail Ltd v Jhuti);
•    EAT: was a dismissal for failure to disclose safeguarding information about the employee being a risk to her own daughter in breach of the employee's human rights (Q v Secretary of State for Justice)
•    EAT: should gross negligence be treated as a conduct or capability issue? (Philander v Leonard Cheshire Disability)
